Terms of Use

1. Introduction and Acceptance

These Terms of Use ("Terms") govern your access to and use of the Myvent mobile application, website, and related services (collectively, the "Platform") operated by MYVENT AI VENTURE ("Myvent", "we", "us", or "our"), a company registered in Malaysia.

By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform. You must be at least 18 years old to use Myvent.

2. About Myvent

Myvent is an AI-powered event management platform that connects event planners with vendors. We act as a marketplace facilitator — we provide the technology platform that enables users and vendors to discover each other, communicate, and transact. We are not a party to the contracts or transactions between users and vendors.

3. Account Registration

• You must provide accurate, complete, and current information when creating your account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• Each individual may maintain only one personal account.
• We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for an extended period.
• You must notify us immediately at myventinfo@gmail.com if you suspect any unauthorised use of your account.

4. Platform Services

Myvent provides the following services:

• Event planning tools (manual and AI-assisted event creation, budgeting, task management, and guest list management)
• Vendor marketplace (discovery, profiles, ratings, and reviews)
• AI chat assistant for event planning guidance and vendor recommendations
• Direct messaging between users and vendors
• Payment processing, escrow protection, and refund management
• Ticketing and RSVP management for public and private events
• Receipt scanning and budget tracking

5. AI Features Disclaimer

Myvent incorporates AI-powered features to assist with event planning. By using these features, you acknowledge and agree that:

• The AI assistant is powered by third-party artificial intelligence technology (OpenAI) and its outputs are generated algorithmically.
• AI recommendations, suggestions, and generated content are advisory only and do not constitute professional event planning, financial, legal, or other professional advice.
• The AI may produce inaccurate, incomplete, or inappropriate responses. You are solely responsible for reviewing and verifying all AI-generated information before acting on it.
• When the AI creates or modifies events on your behalf, the changes are made based on your conversational instructions. You should review all changes for accuracy.
• Vendor recommendations are generated by algorithms based on factors such as budget, location, ratings, and cultural fit. They do not constitute endorsements or guarantees of any vendor's quality or suitability.
• We do not guarantee the accuracy, reliability, or completeness of any AI-generated content.
• You may opt out of AI preference profiling at any time by contacting us.

6. Vendor Marketplace

• Myvent operates as a marketplace facilitator only. We do not employ, endorse, certify, or guarantee any vendor on the Platform.
• Vendor profiles, portfolio content, pricing, and availability information are provided by the vendors themselves. We do not verify the accuracy of this information.
• Ratings and reviews are user-generated and reflect individual experiences. They are not verified or endorsed by Myvent.
• You are responsible for independently evaluating vendors and making your own decisions regarding bookings.
• Any contract or agreement arising from a booking is between you and the vendor directly. Myvent is not a party to such agreements.
• We are not liable for vendor performance, service quality, conduct, cancellations, or any disputes arising from the vendor-user relationship outside the Platform.

7. Payments, Fees, and Escrow

• A 13% service fee is charged to the customer on each booking. This fee is added to the vendor's quoted price at checkout.
• Vendors receive 100% of their quoted price. The service fee is retained by Myvent to operate the Platform.
• Payments are processed through Billplz, a licensed Malaysian payment gateway. Myvent does not directly store your bank account or credit card details.
• Escrow Protection: When you make a deposit or payment for a booking, the funds are held in escrow until the vendor delivers the service. Escrow funds are released after event completion, subject to the dispute window.
• Refunds are subject to the vendor's chosen cancellation policy (see Section 8).
• All prices are displayed in Malaysian Ringgit (RM).
• Myvent is not a bank, financial institution, or licensed money services business. The escrow service is a payment facilitation feature of the Platform.

8. Cancellation and Refund Policies

Each vendor on Myvent sets their own cancellation policy from one of the following tiers:

• Flexible: Full refund if cancelled with reasonable notice before the event.
• Moderate: Full refund if cancelled well in advance; partial refund for later cancellations.
• Firm: Partial refund if cancelled in advance; no refund for late cancellations.
• Strict: Limited refund window; no refund after the deadline.
• Non-Refundable: No refunds after booking confirmation.

The applicable cancellation policy is displayed before you confirm a booking. Refund amounts are calculated based on the vendor's policy and the timing of the cancellation.

The 13% service fee is non-refundable after booking confirmation. When an event is cancelled, refund processing is triggered for all associated bookings according to each vendor's policy. Refunds are typically processed within 7–14 business days.

9. Disputes

• You may file a dispute within 3 days after your event date for issues including: service not delivered, incomplete service, quality issues, or vendor no-show.
• Both users and vendors may submit evidence (photographs and documents) to support their case.
• Myvent will review the dispute and make a determination based on the evidence provided.
• Platform dispute decisions are final within the scope of the Platform's escrow and payment system.
• Filing a dispute on the Platform does not waive your right to pursue legal action independently.

10. Ticketing

• Event organisers are solely responsible for the accuracy of ticket information and the delivery of the advertised event.
• Ticket refund requests are subject to the event organiser's policies.
• QR codes issued for tickets are unique and non-transferable unless the event organiser specifies otherwise.
• Myvent is not responsible for event cancellations, postponements, or changes made by organisers.

11. User Content and Conduct

Ownership: You retain ownership of all content you create on the Platform, including reviews, messages, and uploaded photos. By posting content, you grant Myvent a non-exclusive, worldwide, royalty-free licence to display, host, and distribute your content on the Platform as necessary to provide our services.

Prohibited Conduct: You agree not to:

• Harass, threaten, or abuse other users or vendors
• Post false, misleading, defamatory, or fraudulent content
• Use the Platform for spam, phishing, or unsolicited commercial messages
• Upload illegal, obscene, or harmful content
• Impersonate another person or entity
• Manipulate ratings, reviews, or vendor recommendations
• Attempt to circumvent the Platform's payment system or escrow protections
• Use automated tools, bots, or scripts to access the Platform without authorisation

We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts of repeat offenders. Reviews must be honest, based on genuine experiences, and relate to completed bookings. Messages exchanged on the Platform are private between participants.

12. Intellectual Property

• The Myvent platform, including its design, features, branding, logos, and underlying technology, is the property of MYVENT AI VENTURES and is protected by intellectual property laws.
• You may not copy, modify, distribute, sell, or reverse-engineer any part of the Platform without our prior written consent.
• Vendor content (portfolios, offerings, descriptions) remains the property of the respective vendors.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.
• We are not liable for: vendor performance or service quality; the accuracy of AI-generated recommendations or content; payment disputes between users and vendors that fall outside our dispute process; service interruptions, delays, or technical failures; or loss of data.
• Our total liability to you for any claims arising from or related to your use of the Platform shall not exceed the total fees you paid to Myvent in the 12 months preceding the claim.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities.
• We shall not be liable for events beyond our reasonable control (force majeure), including natural disasters, pandemics, government actions, or widespread internet or infrastructure failures.

14. Indemnification

You agree to indemnify, defend, and hold harmless MYVENT AI VENTURES, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, any content you create or upload, or your infringement of any third-party rights.

15. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Platform, you consent to the data practices described in our Privacy Policy.

16. Modifications to These Terms

We may update these Terms from time to time. For material changes, we will notify you via the app or email before the changes take effect. Your continued use of the Platform after the changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Platform and close your account.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Malaysia.

18. Severability

If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
